Triple Talaq 

Talaq is an Arabic word which means divorce and Triple Talaq means pronouncing ‘Talaq’  (the Arabic word) three times. It is also known by Talaq-e-biddat which means an instant divorce. Triple Talaq is a form of divorce under Sharia Law in Islam in which a Muslim husband could legally divorce his wife by pronouncing ‘Talaq’ word three times. There is no specific format about Triple Talaq pronouncement; it could be oral or written. In the digital era, Triple Talaq pronouncement can be delivered by electronic means such as telephone, SMS, email, or social media. There are different types of divorce in Islam, such as divorce by husband known as Talaq-e-Bidat, divorce by wife known as Talaq-i-Tafweez, and by a mutual agreement known as Mubarat. This instant of divorce is called Triple Talaq also known as ‘Talaq -e-bidat’.

Although the practice of Triple Talaq is commonly held in Sunni Muslims, out of 4 sects of Sunni Muslims, 3 sects are not accepting the practice of Triple Talaq. 4th sect of Sunni Muslims is the only sect that believed in this practice. The Muslim Personal Law Application Act of 1937 had legalized and allowed the practice of Triple Talaq which gives a Muslim husband special privileges over his wife. The wife is not allowed to give divorce under the practice of Triple Talaq. It prescribes waiting periods of three months before the divorce is final in order to give the husband time to reconsider his decision. The percentage of Triple Talaq is rare among the Muslims in India. No official statistics are available about Triple Talaq. As per online records, only 1 percent of people among the Muslims had taken such a type of divorce.

Many Muslim women were fighting against this practice. A survey was conducted by an organization, and they concluded that around 80% of Muslim women are in favor of banning this practice. In August 2017, the court declared the practice unconstitutional after several women filed petitions to the apex court seeking a ban on the practice. The clause under the Muslim Women Protection of Right on Marriage bill 2017 states that “Whoever pronounces Triple Talaq upon his wife shall be punished with imprisonment for a term which may extend to three years and fine.” Under the law, an aggrieved woman is entitled to demand maintenance for her dependent children. On the other hand, there are women who ask to have equal rights, to have the opportunity to keep their marriage intact, and to decide how to end it. 

The All India Muslim Personal Law Board even stated that women could also pronounce triple talaq and execute nikah Namas that stipulated condition so that husband could not say it. Many Muslim-majority countries have stopped recognizing Triple Talaq, but in India, it is protected under Muslim Personal Law, which prevents the state from intervening in religious affairs. The government’s stance on Triple Talaq has left many questioning the impact this could have. Let’s just hope that women who are being treated unfairly by the practice of Triple Talaq get justice.
