The process of building a new government commences immediately after a parliamentary election. This process lays the basis for the policies the new government will proceed with.
This indicates the formation procedure is based mainly on unwritten constitutional law and practice.
A state government is created through the process of elections that are held in the state.
The state is classified into several constituencies that elect their representatives who may be fielded by national or regional political parties or may be independent.
The selected representatives are maintained as members of the state's legislative assembly and are known as MLAs (Member of Legislative Assembly).
The political party or alliance with the simple majority (more than half of the strength of the Assembly) is invited to form the government by the governor.
The MLAs of the greatest party or organization then select their leader from among the house who is declared in by the governor as the Chief Minister of the state.
The government has to then show its majority in the assembly.
If the Chief Minister is not a representative of the assembly at the time of swearing, he/she has to get selected to the assembly within six months of becoming the chief minister.

Note: After an election of a state legislature, the Governor has the potential to call the leader of the party or group who acquired the majority seat in the election to form the government.
